TERMS OF SERVICE

These terms of service are entered into by and between Intent 2 Improve Personal Training Ltd trading as Fortified (hereinafter: ‘Fortified’) and You (hereinafter: ‘the Member’).

1. Services:

Membership entitles the member to usage of Fortified personal training services, classes, nutrition resources and members’ website. 

2. Membership:

Membership is personal, and cannot be shared.

3. Age Limit:

The Member confirms that he/she/they is/are 16 years old or older. For persons under 16 years old, exceptions are granted based on a written parental consent. Persons under 16 years of age must be supervised at all times.

4. Health:

The Member confirms that he/she/they does/do not suffer from health problems that would hinder exercise or prevent him/her/them from engaging in exercise, or that would be detrimental or adverse to the Member’s health, safety or physical condition if he/she/they did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise.

Fortified shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done at Fortified, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a programme and not for diagnostic purposes.

5. Liability:

Each Member of Fortified shall be liable for any property damage and/or personal injury caused by the Member on the Fortified premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.

6. Waiver of Liability:

Any and all use of the Fortified facilities shall be at the Member’s own risk at all times. The Member shall not utilise any equipment unless he/she/they know(s) the appropriate usage. Fortified shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.

7. Session Cancellations:

All sessions cancelled within 6 hours of their displayed start time will be charged in the form of an appropriate session credit. Members must complete the cancellation process within TeamUp should they know they cannot attend, to free up space should there be a waiting list. Failure to attend a booking, without cancelling the session, will also be counted as a late cancellation and charged accordingly.

8. Unused ‘Sessions’:

All sales are final and in no circumstances do individual session credits hold cash value. Unused sessions within a package during the designated month cannot be carried forward to future months, or refunded for a cash amount.

9. Storage for Personal Belongings:

Storage containers are available for Members while exercising in the facility. Each Member should empty the container when leaving the facility. All personal belongings are left at the risk of the owner.

10. Lost Property or Theft:

Fortified does not take responsibility for loss or theft of any personal belongings. Any items found on Fortified premises will be kept for a period of two weeks before being disposed of.

11. Code of Conduct:

The Member shall respect the behavioural and operating principles of Fortified, as laid out in our Code of Conduct.

12. Suspension/Termination of Membership:

If the Member behaves in a way that breaches the Code of Conduct their membership can be suspended or terminated at management’s sole discretion.

13. Access & Security:

Sessions are available according to times stated on TeamUp. Classes and instructors are subject to change with no prior notice.

14. Payment:

The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by Fortified. Agreed price only applies if the Member pays according to the agreed conditions.

The member is responsible for all payments, also in the case of automatic debits by Fortified.

If the payment is late the member will receive a reminder email from Fortified and access may be suspended.

The membership agreement continues to run even if the access is suspended. If, after 30 days, the amount is still not paid, the Member will be deemed to be in violation of the contract, and the total outstanding amount of the contract will be due. Fortified may transfer the case to a debt collector, which will add additional fees.

The first month’s payment or pro-rate amount and any sign-up fee are paid at the point of this agreement. The Member has given approval for an automatic debit from his/her/their account or card.

15. Satisfaction Guarantee:

During 7 days from the start of the membership, the Member can cancel his/her/their membership free of charge, and will be reimbursed in full of any fees paid thus far.

16. Renewal & Cancellation:

Cancellation must be given by email to team@fortifiedgym.com and includes a six week (42 day) notice period from the date of this email. The final billing cycle will be pro-rated to the specific date. For example, notice given on 10th July, would include a reduced payment on 1st August, taking the membership expiry date to 21st August. The only exception to this is if the member wishes to give notice greater than 42 days, in which case we can set a specific expiry date requested.

17. Frozen Membership:

Requests to temporarily freeze a membership must be made in writing to team@fortifiedgym.com, at minimum four weeks (28 days) from the desired date of freeze. A temporary membership freeze can be applied for any amount of days up to eight weeks (56 days) total. A temporary freeze can be applied from and to any date, irrespective of billing dates on the membership, the members next payment upon reactivating the account will pro-rate the amount due, in the circumstance that a membership was frozen during a period in which a member had already paid.

18. Price Changes:

All prices are fixed for the duration of a membership. Any prices changes will be communicated at least one month prior to implementation. All members should expect an annual price increase, at least in line with inflation.

19. Collection of Media:

From time to time we may want to take photographs and/or video of both clients and trainers during sessions for use in our marketing materials. You will be asked for your express permission before training at any Fortified facility. If you do not wish to be included in this, you can also request to be excluded in writing at any time to team@fortifiedgym.com.
