TERMS OF SERVICE
These terms of service are entered into by and between Intent 2 Improve Personal Training Ltd trading as Fortified (hereinafter: ‘Fortified’) and You (hereinafter: ‘the Member’).
1. SERVICES
1.1. The membership entitles the Member to usage of Fortified facilities, its equipment and services therein by appointment only.
2. MEMBERSHIP
2.1. Membership is personal, and cannot be shared.
2.2. Membership constitutes a monthly recurring subscription, including a set amount of session credits for each calendar month.
3. AGE LIMIT
3.1. The Member confirms that they are 16 years old or older. For persons under 16 years old, exceptions are granted based on written parental consent. Persons under 16 years of age must be supervised by a parent/guardian at all times.
4. HEALTH
4.1. The Member will be required to complete a Health Screening Questionnaire (HSQ) prior to exercising within Fortified facilities.
4.2. Fortified may request further information/medical clearance before granting the Member access to Fortified services.
4.3. Fortified shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done at Fortified, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a program and not for diagnostic purposes.
4.4 The Member confirms that they do not suffer from health problems that would hinder exercise or prevent them from engaging in exercise, or that would be detrimental or adverse to the Member’s health, safety or physical condition if they did exercise. In case of any doubt, the Member shall seek advice from a medical doctor who should confirm the ability to exercise.
5. LIABILITY
5.1. Each Member of Fortified shall be liable for any property damage and/or personal injury caused by the Member on the Fortified premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.
6. WAIVER OF LIABILITY
6.1. By entering into this agreement the Member understands that there are inherent risks in participating in a program of strenuous exercise. If the Member sustains or claims to sustain any injury while participating in the program, the Member acknowledges that Fortified and the coaching team are not responsible, except where the injury was caused by gross negligence or by an intentional act of the coach.
6.2. Any and all use of the Fortified facilities shall be at the Member’s own risk at all times. The Member shall not utilise any equipment unless they know the appropriate usage.
6.3. Fortified shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.
7. SESSION CANCELLATIONS
7.1. All sessions cancelled within 6 hours of their displayed start time will be charged in the form of a session credit. Members must complete the cancellation process within the booking system.
7.2. Failure to attend a booking, without cancelling the session, will also be counted as a late cancellation and charged accordingly.
8. UNUSED ‘SESSIONS’
8.1. All sales are final and in no circumstances do individual session credits hold cash value.
8.2. Unused sessions within a package during the designated month cannot be carried forward to future months, or refunded for a cash amount.
8.3. Bolt-on credits do not constitute membership and will expire at the expiration of a membership in line with section 16.
9. STORAGE FOR PERSONAL BELONGINGS
9.1. Limited storage is available for Members while exercising in the facility.
9.2. We recommend that valuables, such as mobile devices/wallets etc. be left in the member’s vehicle. Should any possessions be brought into Fortified, each Member must collect all items when leaving the facility.
9.3. Fortified has the right to remove/dispose of all belongings. Any items found on Fortified premises will be kept for a period of two weeks before being disposed of.
10. LOST PROPERTY OR THEFT
10.1. Fortified does not take responsibility for loss or theft of any personal belongings. Any items found on Fortified premises will be kept for a period of two weeks before being disposed of.
11. CODE OF CONDUCT
11.1. The Member shall respect the behavioural and operating principles of Fortified, as laid out in our Code of Conduct.
12. SUSPENSION/TERMINATION OF MEMBERSHIP
12.1. If the Member behaves in a way that breaches the Code of Conduct their membership can be suspended or terminated at management’s sole discretion.
13. ACCESS & SECURITY
13.1. Sessions are available according to the times stated on the booking system. Classes and instructors are subject to change with no prior notice.
13.2. Access to the facility for training alone is not permitted or included in any Fortified membership.
14. PAYMENT
14.1. The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by Fortified. The agreed price only applies if the Member pays according to the agreed conditions.
14.2. The member is responsible for all payments, also in the case of automatic debits by Fortified.
14.3. If the payment is late the member will receive a reminder email from Fortified and access may be suspended.
14.4. The membership agreement continues to run even if the access is suspended. If, after 30 days, the amount is still not paid, the Member will be deemed to be in violation of the contract, and the total outstanding amount of the contract, including any notice period, will be due. Fortified may transfer the case to a debt collector, which will add additional fees.
14.5. The first month’s payment or prorated amount and any sign-up fee are paid at the point of this agreement. The Member has given approval for an automatic debit from their account or card.
14.6. The Member certifies that they are the holder of the credit/debit card.
14.7. The Member understands that their chosen credit/debit card details will be stored securely via Stripe integration with the Fortified booking system.
15. SATISFACTION GUARANTEE
15.1. During 7 days from the start of the membership, the Member can cancel the membership free of charge and will be reimbursed in full.
16. RENEWAL & CANCELLATION
16.1. The membership extension is triggered by the payment of the subsequent month.
16.2. All recurring memberships renew on the 1st of each calendar month. With each calendar month being one billing cycle.
16.3. Cancellation must be given by email to team@fortifiedgym.com, the date of this email will become the Membership cancellation notice date.
16.4. All Membership cancellations are subject to a 60 day notice period, any payments within this 60 day period will be processed as normal and are non-refundable.
16.5. As part of the cancellation process, you will be asked to complete an exit survey/interview. This will not affect the date from which we take your notice period.
16.5. Memberships that are paid-in-full/non-recurring are final and non-refundable.
17. PAUSED MEMBERSHIP
17.1. Requests to pause membership will only be approved if there is a medical issue where the Member is unable to attend Fortified, a doctor's note will be required as proof.
17.2. The membership may be paused for two billing cycles/calendar months in each calendar year.
17.3. The membership can only be paused for full billing cycles/calendar months.
17.4. The membership cannot be paused for holidays and/or work related purposes.
17.5. Requests to pause membership must be made greater than 30 days in advance from the desired pause start date.
17.6. Requests to temporarily pause a membership must be made in writing to team@fortifiedgym.com.
17.7. Upon expiration of any paused period, membership payment will automatically reactivate and resume.
17.8. If the Member chooses to cancel the Membership in line with section 16.3 during the paused period, normal cancellation terms will come into effect from the date of the cancellation request.
18. PRICE CHANGES
18.1. All prices are fixed for the duration of the membership.
18.2. Any price changes will be communicated at least one month prior to implementation.
18.3. All members should expect an annual price increase, at least in line with inflation.
19. COLLECTION OF MEDIA
19.1. Fortified may collect individual and group photos, videos, and testimonials relating to our services from the Member. We use these for various purposes, including promotional, advertising, and commercial purposes. We ask for permission to use your photo, video, testimonial, and/or any personal information that you choose to share, in any promotional material. Fortified may use any image, written statement, video, testimonial, voice or likeness in its promotional materials and publicity efforts without any compensation. The Member confirms that he/she understands that photos and videos may be retouched or edited and may further be used in publications, print ads, electronic media (e.g. video, Internet) or other media now known or hereafter created. The Member further understands that by participating in the photography or filming or providing written or verbal statements, they release Fortified and its representatives, employees, photographers, and their designees from any and all liability for violation of any privacy or proprietary rights. The Member further agrees to the inclusion of their name.
